All eligible Grand Prize Drawing entries have an equal chance of winning, regardless of whether submitted by completing the online Passport or by mail.

 

1. Eligibility. NO PURCHASE NECESSARY.  The Hot Topic/New Moon “Passport to Italy” Sweepstakes (the “Sweepstakes”) is open and offered only to legal U. S. residents age 13 or older as of November 11, 2009, who, at the time of entry, reside in and are physically located in the 50 United States (includes DC).  Employees, directors, agents and/or affiliates of Hot Topic, Inc., 18305 E. San Jose Avenue, City of Industry, CA 91748 (“Sponsor”) and Summit Entertainment, L.L.C. (“Summit”) or their respective subsidiaries, and their immediate family (spouse, parents, siblings and children, and each of their spouses) and persons living in the same household are ineligible to enter or win a prize. By entering the Sweepstakes, you (or your parent/legal guardian if you are a minor in the jurisdiction of your primary residence, on their and your behalf) agree to be bound by the terms and conditions of these Official Rules. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. All decisions of Sponsor are final. Void where prohibited. Summit is not responsible for the administration of the Sweepstakes, the collection of entries, or the selection of winners.

 

2. Entry. Sweepstakes begins at 12:01AM Pacific Time (“PT”) on November 11, 2009 and ends at 11:59PM PT on November 21, 2009, and includes entry periods on November 13, 15, 16 and 19, 2009, for Daily Prize Drawings in addition to the Grand Prize Drawing. The Sweepstakes will be conducted and administered at the sole discretion of Sponsor.

 

            Grand Prize Drawing – two ways to enter: 1) Online “Passport to Italy” activities: Enter online by providing full name, mailing address, email address and telephone number(s) and other information as directed at www.hottopic.com, and then completing 10 daily Passport to Italy activities. Completed online entry must be received by Sponsor by 11:59 PM PT on November 21, 2009. A new daily Passport to Italy activity will be announced each day from November 11 to 20, 2009, at 12:01 AM PT. Once announced, an activity may be completed at any time until the end of the Sweepstakes.  Activities include obtaining answers to clues online and a visit to view a Hot Topic store window.  2) By mail: Enter by providing your full name, mailing address (with zip code), date of birth, and telephone number(s) on a 3.5” x 5” postcard mailed to: Hot Topic/New Moon “Passport to Italy” Sweepstakes, c/o Hot Topic Internet Marketing, Hot Topic, Inc., 18305 E. San Jose Avenue, City of Industry, CA 91748.  There is no need to start or complete the Passport to Italy activities in order to enter by mail. Entrants who start online may decide at any point until November 21, 2009, to enter by mail instead. All mailed entries must be postmarked by November 21, 2009 and received no later than November 28, 2009. Limit one entry per person/email address regardless of entry method chosen.

 

            Daily Prize Drawings – enter online on Nov. 13, 15, 16 or 19: Enter by completing that day’s daily Passport to Italy activity by 11:59 PM that day.  Daily Prize Drawings are open to anyone otherwise eligible; Daily Prize Drawing entrants need not enter Grand Prize Drawing or complete other Passport activities. Limit one entry per person/email address for each Daily Prize Drawing. Each Daily Prize Drawing is independent of the others, and entry into a Daily Prize Drawing will not constitute entry into the Grand Prize Drawing. Entries into one Daily Prize Drawing will not carry over into other Daily Prize Drawings.

 

Regardless of drawing entered, entries that are late,  illegible, incomplete, damaged, destroyed, delayed, lost, tampered with, incomprehensible, forged,  mutilated, misdirected, inaccurate, unintelligible or otherwise not in compliance with these Official Rules will be disqualified. All entries generated by an electronic script, macro or other automated/repetitive means (except as permitted in these Official Rules) will be disqualified and ineligible for the Sweepstakes. Sponsor and/or Summit are not responsible for late or misdirected online entries, computer problems, or internet communications. For purposes of this Sweepstakes, email addresses are deemed to belong to the individual whose name appears on the email account as owner. If there is a dispute about the identity of an entrant and such dispute cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible. Sponsor is not responsible for late, lost, stolen, misdirected, mutilated or postage due mail.  Transportation, concessions, and all other costs not specifically referenced herein are the sole responsibility of the participant. By participating in this Sweepstakes, participants agree that their contact information can be shared between Sponsor and Summit. Such information may be used by Sponsor in accordance with the Hot Topic, Inc. Privacy Policy:  http://community.hottopic.com/customerservice/privacy.asp and may be used by Summit in accordance with the Summit Entertainment, L.L.C. Privacy Policy: http://www.summit-ent.com.

 

3. Drawings/Odds:

 

            Grand Prize Drawing: On or around November 30, 2009, Sponsor will randomly draw one Grand Prize Winner ("Grand Prize Winner") from all eligible mail-in and online Passport entries received.  Time is of the essence in awarding the Grand Prize. Accordingly, Potential Grand Prize winner must respond to notification by December 4, 2009, or prize may be forfeited and an alternate winner chosen.

 

            Daily Prize Drawings: Four Daily Prize Drawings, one each to be held from among all eligible entries received online on Nov. 13, 15, 16 and 19. The first three Daily Prize Drawings will be held on or about Nov. 14, 16 and 17, respectively. Winners in the Nov. 19 Daily Prize Drawing will be selected one each in drawings on or about November 20 through 29. Potential winners will be notified on or about the day of drawing. 

 

Many will enter, only one winner will be chosen for the Grand Prize and each Daily Prize. Actual odds of winning depend on the total number of eligible entries received in each drawing. Potential winners will be notified by email or telephone (Sponsor’s choice), on or about the drawing date. Sponsor is not obligated to leave voice mail, answering machine or other message.

 

If Prize or notification of Prize is returned as undeliverable, Winner will be disqualified and another Winner chosen.  Prizes may not be transferred, redeemed for cash, or substituted.  Grand Prize winner will be required to provide his/her/parent’s/guardian’s US Social Security Number for tax purposes as well as a valid government issued photo identification card.

4. Prizes:  One (1) Grand Prize. Consists of these items only: (i) One (1) roundtrip flight to Italy (to Florence, or other city close to film shoot in Italy) for winner and one (1) guest (Approximate Retail Value (“ARV”): $2000), (ii) Six (6) days and five (5) nights accommodations (standard room, double occupancy) in a hotel to be determined (at the sole discretion of the Sponsor) (ARV: $1500), (iii) ground transportation to and from the airport and all attractions (ARV:$400), (iv) $1,000 cash spending money. The TOTAL ARV is Four Thousand Nine Hundred Dollars ($4,900.00) (the “Grand Prize"). Winner and guest must travel on same itinerary. Flight will initiate from major US airport near winner’s residence as selected by Sponsor in its sole discretion. Actual value of Grand Prize may vary based on point of departure and airfare fluctuations. An IRS Form 1099 showing the actual value of the prize as income to the winner/parent/guardian will be issued, and any difference between the actual value and the value estimated in these rules will not be awarded. Selection of airline and hotel are solely within Sponsor’s discretion. Meals, gratuities, luggage fees, incidental hotel charges and any other travel-related expenses not specified herein are the sole responsibility of winner.  Exact travel dates and arrangements subject to availability. If winner is eligible, but a minor in his/her state of residence, the travel guest must be winner’s parent or legal guardian. A minor may accompany winner as a travel guest only if the winner is the minor’s parent or legal guardian. Minors must be accompanied at all times during trip (including, but not limited to, in-flight, hotel stay and all prize-related events) by minor’s parent or legal guardian. Travel guests must sign and return a travel release before any ticketing of travel occurs. Winner and guest must have all necessary identification and/or travel documents, including a US passport, required for travel. 

 

-- A 10-pack of movie tickets (ARV $100) from Fandango.com will be awarded in a drawing from among all eligible November 13, 2009 entrants (enter online by completing Activity #3 on November 13, 2009).

-- A $100 Hot Topic gift card (ARV: $100) will be awarded in a drawing from among all eligible November 15, 2009 entrants (enter online or by completing Activity #5 on November 15, 2009).

-- A cell phone and a $100 gift card from AT&T Wireless (ARV: $300) will be awarded in a drawing from among all eligible November 16, 2009 entrants (enter online or by completing Activity #6 on November 16, 2009). Make and model cell phone as determined by AT&T. Normal conditions and restrictions apply to gift card.

-- Ten (10) Win Your Wishlist prizes, each consisting of entrant’s Wishlist of five items from hottopic.com (ARV: $250 each). Ten Wishlist prizes will be awarded in a drawing from among all eligible November 19, 2009 entrants (enter online by completing Activity #10 on November 19, 2009).

 

Winners will be solely responsible for any and all taxes in connection with the Prize won and all other expenses and/or terms not specifically described as part of the Prize. Gift cards are subject to terms and conditions stated on such gift cards and additional material restrictions may apply.

Sponsor reserves the right to substitute any items in prize package based on availability.

5. General Conditions:  By participating in the Sweepstakes, you, together with your heirs and assigns, (a) release and forever hold harmless Sponsor and Summit Entertainment, L.L.C., and each of their respective affiliates, parent companies, subsidiaries,  and divisions and each of their respective employees, directors, shareholders, and agents (collectively,  "Releasees") from any liability whatsoever for any and all claims, costs, losses, or damages of any kind (including, without limitation, those related to personal injury, death, damage to property, infringement or  proprietary rights, rights of publicity, privacy or defamation) arising out of or in connection with your or any  third party's participation in the Sweepstakes and/or Sweepstakes-related activity including, but not limited to, the  use or misuse of any Sweepstakes prize, and (b) agree and acknowledge that Releasees are not responsible for and shall not be liable for: (i) late, lost, stolen, delayed, misdirected, postage due, mutilated, incomplete,  unreadable, inaccurate, garbled or unintelligible entries or notices; (ii) telephone system, facsimile, technical  or computer malfunctions, lost connections or transmissions, disconnections or other errors of any kind whether  mechanical, human, electronic or otherwise relating to or in connection with the Sweepstakes, including, without  limitation, errors which may occur in connection with the administration of the Sweepstakes or the processing of  entries; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other  materials; (iv) any injuries, losses, costs, expenses or damages to person or property of any kind caused, in whole  or in part, directly or indirectly, by the prize or resulting from redemption, acceptance, possession, loss or use  (including, but not limited to, attendance at an event) or misuse of any prize or from participating in the  Sweepstakes or any Sweepstakes-related activity (including, without limitation, any travel to or from any location  to receive or use a prize); (v) inability to participate in the Sweepstakes; or (vi) any printing, typographical,  human, administrative or technological errors in any material associated with the Sweepstakes. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, human or other error or problem, a random drawing will take place from among all eligible prize claims for the prize(s) at issue (or from among all persons so notified) to award the proper number of prizes as set forth in these Official Rules.  Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances.  No more than the number of prizes stated in these Official Rules will be awarded.  Winners grant Sponsor and Summit the right to use and publish Winners’  name, bio, portrait, picture, voice and likeness for any trade, advertising or promotional purpose (including, but  not limited to promotion of the Sweepstakes) in any and all known media, in perpetuity, all without further  compensation, notification, review or approval, unless imposing such condition is prohibited by law.  As part of the verification process, Winners (or parent/legal guardian if winner is a minor) must complete, execute and return an Affidavit of Eligibility, Liability Release, and where lawful, Publicity Release within 5 days of notification.  Failure to return documents as specified herein will result in disqualification and forfeiture of the prize.  The age of majority varies by state. If applicable, a Prize won by a minor may be awarded in the name of the minor's parent/legal guardian, as determined by Sponsor.  If any Winner(s) is deemed to be ineligible, does not comply with these Official Rules or cannot accept a Prize as stated, the Prize will be deemed forfeited and may be awarded to an alternate winner.  Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) should an error or virus, bug, computer problem or other cause or problem corrupt or inhibit the administration, security or proper operation of the Sweepstakes and, in such situation, to select the winner from among the remaining eligible, non-suspect entries received prior to and/or after the action taken or in such manner as deemed fair and appropriate by Sponsor in its sole discretion.  In the event the Sweepstakes is modified, cancelled or suspended, notification of such event will be posted at www.hottopic.com.  Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, or to be acting in violation of these terms and conditions, and may prosecute such individuals to the full extent of the law.  Sponsor shall have the right to interpret and apply these terms and conditions to individual circumstances in its reasonable discretion.  THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OVER ANY CONTROVERSIES REGARDING THE SWEEPSTAKES, WHICH SHALL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA (EXCLUDING CONFLICT OF LAWS PROVISIONS).  VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

6. Publicity Release: Except where imposing such condition is prohibited, entry constitutes entrant’s consent to Sponsor’s use of name, likeness, voice and/or biographical data for advertising and promotional purposes in relation to the Sweepstakes, without limitation and without additional notice, compensation, or consent.

 

7. Winners List: On or about December 7, 2009, the name of the Grand Prize Winner will be posted online at www.hottopic.com.  Winners in the four Daily Prize Drawings will be posted within approximately one day of drawing. Or, for a list of winners, mail a self-addressed stamped envelope to: Hot Topic/New Moon “Passport to Italy”Sweepstakes Winners List, c/o Hot Topic Internet Marketing, Hot Topic, Inc., 18305 E. San Jose Avenue, City of Industry, CA 91748.  Requests must be received by December 31, 2009.

8.
