ELIGIBILITY: The Hot Topic program ("HT+1 YOUR FRIEND WITH BENEFITS") is made available by Hot Topic, Inc. ("Hot Topic").  The HT+1 YOUR FRIEND WITH BENEFITS program is offered only in the State of New Mexico to residents of that State who are least 13 years old at time of participation and have a valid email account. HT+1 YOUR FRIEND WITH BENEFITS will offer the ability to accrue points to enrolled members who participate in activities and/or purchase products sold at participating Hot Topic retail stores in New Mexico. Present your HT+1 YOUR FRIEND WITH BENEFITS membership card prior to checkout and receive one hundred (100) reward points for each dollar of the net purchase price of all items purchased on Qualifying Purchases (each a "Point"). No purchase is necessary to become a Member.

REGISTRATION: To participate in HT+1 YOUR FRIEND WITH BENEFITS you must enroll to become a member by registering your information with Hot Topic by creating a member account ("account"). You must have a valid email address to participate in the HT+1 YOUR FRIEND WITH BENEFITS program in order to receive offers and information about rewards. It is your responsibility to read and agree to these Terms and Conditions. You will become a HT+1 YOUR FRIEND WITH BENEFITS member upon submitting the required information as directed and confirming that you have read and agree to these Terms and Conditions. By participating, you and your parent/legal guardian if you are a minor in your jurisdiction of residence, agree to the HT+1 YOUR FRIEND WITH BENEFITS Terms and Conditions which may change from time to time and notices of these changes will be posted on hottopic.com. All decisions of Hot Topic are final and binding in all matters relating to this HT+1 YOUR FRIEND WITH BENEFITS program.

PARTICIPATION/POINTS:

	When an individual registers for the HT+1 YOUR FRIEND WITH BENEFITS program, a member account will be established for that individual. For each Qualifying Purchase made by the member, the member will receive one hundred (100) reward points for each dollar of the net purchase price of all items purchased. The net purchase price will mean the price of the item(s) purchased only, and will not include taxes, shipping costs and price alterations. Points will be credited to the member and deposited in the member’s account.
	When products are returned to the store or by mail, the same number of points that had been credited to the member’s account for the purchase of those products will be deducted from your member account for that product return.
	Members may earn points by visiting participating Hot Topic Retail stores. Ten (10) points will be available per store visit; however points will only be awarded once per day and will only be awarded if the member registers the store visit with a store sales associate.
	The sale, trading, transfer, assignment, combining or barter of points is prohibited. You may not register for another individual, transfer your membership card, points or benefits of the HT+1 YOUR FRIEND WITH BENEFITS rewards to anyone else.
	Points have no cash value, and may not be purchased or redeemed for cash or credit. Points may only be used in a manner consistent with, and as stated in, these Terms and conditions.
	Points will only be credited to the account of the member making the qualified purchase.
	If the member does not earn any points during any continuous (rolling) 12-month period, (including if this program is renewed or expanded as permitted below) your HT+1 YOUR FRIEND WITH BENEFITS membership will automatically expire on the last day of the 12th month of account inactivity, the member account will be inactivated and any points remaining in the member account will be forfeited.
	Points will post to a member’s account within 14 days from the date of any qualified in-store or online purchase.
	Points may be redeemed for special offers and/or promotions determined and offered by Hot Topic from time to time. Restrictions and rules may apply to each offer and promotion and may differ depending on each particular offer or promotion.

REDEEMING POINTS AND RESTRICTIONS:

	When points are available for redemption, Hot Topic will notify the member of the specifics of offers and/or promotions through email and/or point of sale. A member can always inquire of the status of points earned by going to a Hot Topic store in New Mexico and inquiring about their account, or calling our Hot Topic Customer Service at 800-892-8674. Because qualifying promotions and offers may be subject to restrictions, it is the member’s sole responsibility to check their email and account status for special promotions and offers and other rewards and comply with their respective restrictions.
	While reasonable efforts will be made to record, maintain and keep current the point and other information (if any) in your account, due to technical or other errors or failures, the information may not always be current and accurate; and there will be no responsibility or liability for any such failure to record or maintain information accurately.
	The member has the right to accept the offer, or decline the offer and save points for future use. Points not used will remain in accounts.
	A Qualifying Purchase is a purchase made at any Hot Topic store in New Mexico not listed as a Non-Qualifying Purchase below. However, Qualifying Purchases may change and may be subject to other restrictions.
	Hot Topic employees are eligible for participation in the HT+1 YOUR FRIEND WITH BENEFITS program but may also be subject to additional restrictions.

NON-QUALIFYING PURCHASES:

HT+1 YOUR FRIEND WITH BENEFITS Points will not be earned for the following: Purchases made for resale, purchases of Hot Topic gift card, sales tax, state fees, shipping charges, delivery charges, restocking fees, charitable items and items specifically excluded in particular promotions other excluded charges. Other exclusions may apply and will be communicated if applicable. Non-qualifying purchases may be changed and amended from time to time.

MEMBERSHIP CANCELLATION, MODIFICATION, EXPIRATION AND TERMINATION:

	You may cancel your membership at any time by notifying Hot Topic customer service by mail at HT +1 Your Friends With Benefits Program, 18305 E, San Jose Avenue, City of Industry, CA 91748, or e-mail us at HTplus1Support@hottopic.com or telephone our customer service at 800-892-8674. Cancellation may take from 6 to 8 weeks to complete.
	HT+1 YOUR FRIEND WITH BENEFITS will run through October 2, 2009, on which date it will expire unless it is automatically renewed or expanded into additional markets (which could include program changes determined solely by Hot Topic), or terminated prior to that date at the sole discretion of Hot Topic, Inc. If HT+1 YOUR FRIEND WITH BENEFITS is renewed, or expanded into additional markets, the points earned herein will be carried forward into those programs. If this program is terminated prior to October 2, 2009, or allowed to expire on that date points earned in this program will be forfeited. Hot Topic will provide notice of its plans relating to the program, and in the event that such plans would result in point forfeiture provide a reasonable opportunity, as determined by Hot Topic, Inc to use those points.
	Any term or condition in these Terms and Condition which is prohibited by law will not be effective or binding, and will have no effect on the validity and interpretation of the remainder of these Terms and Conditions.

PRIVACY AND MISC:

	The information that you provide when you register to become a HT+1 YOUR FRIEND WITH BENEFITS member will be subject to the Hot Topic Privacy Policy. The Privacy Policy can be accessed through the Web site by clicking on the Privacy Policy link, or you can go directly to http://community.hottopic.com/content/privacy-security.
	We will occasionally send you information on products, services, special deals, promotions. Out of respect for your privacy, we present the option not to receive these types of communications. You may opt-out of receiving these emails by following the directions for opting out in our email.
	We will still need to send you emails about the HT +1 YOUR FRIEND WITH BENEFITS program to tell you about offers and rewards you qualify for. But you can opt out of receiving emails about the HT+1 YOUR FRIEND WITH BENEFITS program completely by stopping your participation in the rewards program. Members may choose to opt out of the Program at any time as discussed in Member Cancellation above by providing notice by mail, or by sending us an e-mail at HTplus1Support@hottopic.com or by calling our customer service at 800-892-8674; however, all Points shall be forfeited at such time.
	These Terms and Conditions and our legal obligations are subject to the laws of the State of California and the United States, regardless of the location of any user. Any claims or complaints must be filed in the United States in the State of California.
	Hot Topic is not responsible for incomplete, lost, late, damaged, illegible or misdirected or postage due mail, email or mobile messages or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer or mobile transmission, or any program or programming errors or failures, or any unauthorized human intervention (including but not limited to hacking), or the failure to capture or loss of any information or any combination thereof. Further, Hot Topic is not responsible for any information, mis-information, or failure to provide information due in whole or in part to any reason stated in the previous sentence. Hot Topic is not responsible for any liability for damage to any computer system or mobile phone resulting from participation in or accessing or downloading information in connection with this program. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Hot Topic reserves the right at its sole discretion to disqualify or restrict access from any individual who tampers with the program process. In the event of a dispute regarding any program transaction, the transaction will be deemed made by the authorized account holder of the HT+1 YOUR FRIEND WITH BENEFITS account making the transaction. Hot Topic assumes no responsibility for undeliverable emails or mobile messages resulting from any form of active or passive email or mobile filtering by a user’s internet service provider / mobile provider and/or email client or for insufficient space in user’s email or mobile phone account to receive email or messages. Hot Topic reserves the right, in its sole discretion, to cancel or suspend this program should a virus, bug, or other causes beyond the control of the Hot Topic corrupt the administration, security or proper operation of the program. In the event of termination, a notice will be posted online. Hot Topic reserves the right to modify the promotion or disqualify participants if fraud, misconduct or technical failures destroy the integrity of the program as determined by Hot Topic, in its sole discretion. All federal, state and local laws and regulations apply.

These Terms and Conditions are for the test pilot in New Mexico Hot Topic stores only and the rules of HT+1 Your Friend with Benefits may change.
