1.         Eligibility: The God Of Thunder’s Hammer Sweepstakes (“Sweepstakes”) is open to legal U.S. residents of the 50 United States and the District of Columbia age 13 or older as of April 8, 2011. Employees, officers, directors, independent contractors, representatives, affiliates or agents of Hot Topic, Inc. ("Sponsor") and Paramount Pictures Corporation (“Prize Provider”), and each of their respective parent companies, subsidiaries, licensors, distributors, divisions, and their respective advertising and promotional agencies (collectively, the “Sweepstakes Entities”) and their respective immediate family members (parent, sibling, spouse, child) and/or those living in the same household (whether related or not) are ineligible to enter this Sweepstakes and cannot win any prize.  By entering the Sweepstakes, you (or your parent/legal guardian if you are a minor in your jurisdiction of primary residence, on their and your behalf) agree to be bound by these Official Rules. All decisions of Sponsor are final. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law. 

 

2.         How To Enter: Go to a participating Hot Topic store between the hours of 12:01 p.m. and 3:59 p.m. on April 9 or April 10, 2011 except where noted in Exhibit A. The First Prize promotion will continue until 3:59 p.m. April 10, or until the ending time noted in Exhibit A. The Grand Prize promotion will end at 3:59 p.m. April 10, 2011 (or other time noted in Exhibit A) or when the Grand Prize is awarded, whichever is first. A minor who wishes to participate must be accompanied a by parent or legal guardian. A total of ten (10) Hot Topic stores will participate only.  Specific Hot Topic store locations and event times are listed in Exhibit A. Some participating stores may vary in event times. All times referenced in these Official Rules are local time at the specific event site. Fill out an entry form and drop it in the God of Thunder’s Hammer Ballot Box. You (or your parent/legal guardian if you are a minor in your jurisdiction of primary residence, on their and your behalf) will be asked to enter your first and last name, mailing address, age, E-mail address and telephone number. Each person who fills out an entry form will receive one chance to touch or attempt to pick up “Thor’s” hammer to see if it unlocks. If the hammer unlocks, the entrant will win the grand prize, subject to verification of eligibility and identity. Limit one (1) entry per person. The promotion at each participating Hot Topic store is a separate sweepstakes. Only one Grand Prize will be awarded per store location. Once the Grand Prize is awarded, the Grand Prize promotion at that location will end, but entries will still be accepted until 3:59 p.m. April 10, 2011 (or other time noted in Exhibit A), for the First Prize drawing.

 

All ballot entries must be received by 3:59 p.m. local time on April 10, 2011. Specific Hot Topic store locations and event times are listed in Exhibit A. Sponsor reserves the right to end the promotion at 4 p.m. April 10, 2011, and deem remaining entrants not eligible. Proof of entry submission does not equate to proof of timely receipt. Sponsor is not responsible for late, lost, stolen, misdirected, and mutilated entries. Illegible/incomplete entries are automatically disqualified. Entries become the property of Sponsor and will not be returned. 

3.         Prizes:

 

(1)   Each of the ten (10) participating Hot Topic stores will each have One (1) Grand Prize Winner:

 

Each Grand Prize includes: Two (2) round-trip, economy class airline tickets to Los Angeles (or, in Sponsor’s reasonable discretion, round-trip ground transportation), approximate retail value (“ARV”) up to $1,200; (MINOR MUST BE ACCOMPANIED BY A PARENT OR LEGAL GUARDIAN) One room (double occupancy), three (3) night stay at the Renaissance Hollywood, ARV $750; Round-trip airport/hotel taxi reimbursements in Los Angeles, ARV $140; Admission for two (2) to the Premiere on Monday, May 2^nd at the El Capitan Theater in Hollywood to see the movie: “THOR”, ARV is $20. TOTAL GRAND PRIZE ARV:  $2,110. See additional conditions below.

 

(2)   Each of the ten (10) participating Hot Topic stores will also have ten (10) First Prize Winners, subject to availability:

 

Ten (10) First Prizes: Each First Prize consists of: Two (2) screening passes to see the movie: “THOR”; ARV for the two (2) screening passes is $20. TOTAL ARV FOR ALL TEN FIRST PRIZES IS $200. Date for each pair screening passes to be determined solely by Sponsor.

 

4.         Grand Prize Winner Selection and Eligibility and Additional Conditions: “Thor’s” hammer will be set to unlock at a previously determined but undisclosed try (for example, the 300th try). The designated try will vary by store. The designated try may occur on either April 9 or 10. For Hot Topic Store locations and event times, please see Exhibit A. The entrant on whose try the hammer unlocks will be designated the potential Grand Prize winner, subject to verification of eligibility and identity. If the apparent Grand Prize winner is not eligible, Sponsor may, at its discretion, reset the hammer to open at a later try or may revert to the Alternative Selection process outlined below. 

 

            Additional Conditions: Sponsor will determine, in its sole discretion, based on Grand Prize winner’s proximity to Renaissance Hollywood hotel and/or Los Angeles, CA, whether to award travel in the form of air travel, ground transport or transportation stipend (entrant drives). Air travel will be from major airport near winner’s residence, as selected by Sponsor. Grand Prize Winner and his/her travel companion must travel on same itinerary. Actual value of Grand Prize may vary based on point of origination, airfare fluctuations and air/ground travel options. Any difference between actual travel and stated ARV will not be awarded in cash or otherwise. Grand Prize must be redeemed and travel must take place between April 30, 2011 and May 3, 2011. If Grand Prize winner is unable to complete trip on the dates selected by the Sponsor, the Grand Prize winner shall forfeit the prize in its entirety and an alternate Grand Prize winner may be selected, time permitting. Trip coordination will be handled by Sponsor. Winner’s guest must be 18 or older or the parent, legal guardian, child, legal ward or spouse of the winner. One member of the travel party must be 18 or older. Grand Prize includes only those items listed and does not include meals, hotel room service; laundry service; alcoholic beverages; merchandise, souvenirs, spa services; local and long distance telephone calls; tips, gratuities; incidental expenses; travel insurance; or any other costs and expenses not otherwise expressly stated. Grand Prize winner and his/her travel companion are solely responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Certain conditions and restrictions apply. Grand Prize must be used by the Grand Prize Winner and guest and may not be sold, traded, transferred, refunded, redeemed for cash value or rescheduled to dates other than specified. In the event that the movie premiere is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. By entering this Sweepstakes and accepting the Grand Prize, the Grand Prize winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Sweepstakes or prize-related activity. The Grand Prize winner understands and agrees that Sponsor or any prize provider has the right, in its sole discretion, to disqualify and remove the winner and/or any guest from any activity at any time if the winner or a guest’s behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor or any prize provider or otherwise violates the policies of the prize providers. 

 

The Sweepstakes Entities are not responsible or liable to any entrant or winner or any person claiming through such entrant or winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, volcanic eruption, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Sweepstakes Entities’ sole control.

 

First Prize Movie Winner Selection and Eligibility: At or about 4 p.m. April 10, 2011, Sponsor will draw ten (10) names per store from the ballot box entries received as of 3:59 p.m. April 10, 2011 local time (times will be adjusted accordingly at stores with different ending times noted in Exhibit A), You need not be present to win. First Prize screening passes will be handed out on site in person if the winner is present or otherwise sent by U.S. Mail to the address on the winning entry. First Prize winners collecting prizes on site may be required to complete a prize acceptance form and verify identity before prize is awarded. If mailing is returned as undeliverable at that address, that potential winner will be disqualified. Unclaimed First Prizes will not be awarded.

 

Alternative Grand Prize Selection: If no Grand Prize winner is selected at a given site by 4 p.m. April 10, 2011, or if a potential Grand Prize winner is selected but determined not to be eligible and an alternative selection is warranted, then the grand prize winner will be selected through a random drawing from among the eligible ballot box entries received as of 3:59 p.m. April 10, 2011 (or other ending time as noted on Exhibit A).

 

Winners will be notified at the time of the event or by telephone, e-mail or mail as needed. Sponsor and/or Sweepstakes Service Provider reserves the right to determine the method of notification. Potential Grand Prize winner (or parent or legal guardian if potential winner is a minor) will be required to complete and return, within three (3) days of notification, an affidavit of eligibility and liability and, where legal, a publicity release (the "Release"). Failure to sign and return the Release within three (3) days of receipt will result in forfeiture of the prize. Refusal or return of prize notification as undeliverable will result in disqualification. .

 

Odds of winning depend on the number of eligible entrants who participate and upon the randomly chosen winning tries. 

 

WINNER WILL BE SOLELY RESPONSIBLE FOR ANY AND ALL FEDERAL, STATE AND LOCAL TAXES IN CONNECTION WITH THE PRIZE AND ALL OTHER EXPENSES AND/OR TERMS NOT SPECIFICALLY DESCRIBED AS PART OF THE PRIZE. An IRS Form 1099 or equivalent will be issued to Grand Prize winner (or parent/legal guardian) showing the value of the prize as income. Prizes may not be transferred, redeemed for cash, or substituted by Winner.  Potential Grand Prize Winner (or parent or legal guardian if potential winner is a minor) will be required to provide a valid driver’s license or other form of identification and U.S. Social Security Number or taxypayer i.d. for tax purposes. The decision(s) of the Sponsor in all matters regarding the Sweepstakes are final and binding.

By participating in the Sweepstakes, all entrants agree to be bound by these Official Rules. By participating and/or accepting a prize, Winner (or, if a minor, Winner's parent or legal guardian) (i) agrees to release, discharge, indemnify and forever hold harmless the Sweepstakes Entities and each of their respective affiliates, licensors, officers, directors, employees, independent contractors, representatives and agents and each of their respective advertising and promotional agencies from and against any liability whatsoever for any claims, damages, costs, or liability due to any, injuries, damages, or losses to any person (including death) or property of any kind (including, without limitation, those related to infringement of proprietary rights, rights of publicity, privacy, or defamation), resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or arising out of or in connection with any Winner's or any third party's participation in any Sweepstakes-related activity or participation in this Sweepstakes.

 

Publicity Release. By entering and accepting prize, each entrant and Winner grants to Sponsor, Prize Provider and/or Sweepstakes Service Provider and their respective parent companies, licensors, trustees, subsidiaries, franchisees, affiliates, licensees, directors, officers, employees, independent contractors, representatives and agents and their respective advertising and promotional agencies the right to use and publish Winner's name, biographical information, portrait, picture, statements, voice, and likeness for trade, advertising and promotional purposes, on a worldwide basis, in perpetuity, in all forms of media solely in connection with the Sweepstakes, without any further compensation or consideration unless where prohibited by law. Sponsor, at its sole discretion, reserves the right to cancel or modify the Sweepstakes, without notice or liability. 

Any person attempting to defraud or in any way tamper with this Sweepstakes and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF CALIFORNIA (EXCLUSIVE OF CONFLICTS OF LAWS PROVISIONS) SHALL GOVERN THE SWEEPSTAKES. VOID WHERE RESTRICTED OR PROHIBITED BY LAW. 

5.         Who Won? Copy of Rules?: For a list of winners and/or official rules, mail a self-addressed stamped envelope to: Hot Topic’s God of Thunder Hammer Sweepstakes Winners' List or Official Rules, c/o Hot Topic Marketing Department, 18305 E. San Jose Ave., City of Industry, CA 91748. Requests must be received by October 10, 2011. VT residents may omit return postage.
